Toni Braxton’s debts discharged in Chapter 7 bankruptcy

Grammy award-winning singer Toni Braxton recently had many of her debts discharged under Chapter 7 bankruptcy.

The singer filed for bankruptcy last September. The Chapter 7 filing listed $18.3 million in debts and $1.6 million in assets.

Under Chapter 7 bankruptcy, certain types of debts are eligible to be discharged. An order from the U.S. Bankruptcy Court in Los Angeles states that most of the singer’s eligible debts were discharged. Some taxes, student loans, criminal fines, and domestic-support payments are not eligible for discharge.

With the order, Braxton is no longer responsible for paying off certain debts. In addition, creditors are prevented from taking action against the singer for repayment.

Alabama Aircraft Industries submits reorganization plan

This week, Alabama Aircraft Industries Inc. submitted a reorganization plan that proposes selling the majority of their assets to Kaiser Group Holding out of Virginia for $500,000.

Chief Executive of the military aircraft modification company operating out of Birmingham-Shuttlesworth International Airport said of Kaiser, “Their plan is that they intend to continue to operate the facility as a maintenance and overhaul center.  They have the financial stability that we require right now.”

The company filed for bankruptcy in February listing around $69 million in debt to the United Auto Workers pension plan.

Bankruptcy filings decrease in year ending June 2011

Recent figures from the Administrative Office of the U.S. Courts reveal that total bankruptcies filed in the U.S. in the year ending June 2011 decreased by 2.7 percent.

In addition, the figures detail the decreases in each individual chapter of bankruptcy.  Chapter 13 bankruptcies declined by the smallest amount  in the year ending June 2011 with a 2 percent decrease.  Chapter 7 filings decreased by 4 percent, Chapter 13 filings decreased by 9 percent, and Chapter 11 filings decreased by 11 percent.

75 out of 94 districts in the U.S. experienced decreases in bankruptcy filings.  Districts that saw increases in bankruptcy filings included the Southern District of Florida and the Central Districts of California and Utah.

Percentage of seniors filing for bankruptcy on the rise

Several recent bankruptcy studies have concluded that the percentage of seniors seeking bankruptcy protection is on the rise.

For instance, one study says that in 2006, seniors accounted for 7.8 percent of the nation’s total bankruptcy filings.  In 2009, the number of seniors filing for bankruptcy increased to 8.3 percent of the total amount of bankruptcies filed in the U.S.

Experts in bankruptcy say that the demographic of people age 65 and older is the fast growing demographic choosing bankruptcy.  One study notes, “While health issues and medical debts are also contributing to bankruptcy filings by the elderly, credit card debt among the elderly has also risen, with a median of $22,562 being owed to credit card companies among filers 65 years and older.”

Jefferson County delays bankruptcy filing

Yesterday, Jefferson County officials delayed their potential chapter 9 bankruptcy filing for the second time in two weeks.  Authorities now say they will have an agreement on entering into bankruptcy protection ready by next Friday, August 12.

Governor Bentley has been working with county officials to decide how to resolve Jefferson’s $3.14 billion in debt.  One of the major issues being discussed is the county’s sewer rates.  Over the past 10 years, Jefferson’s sewer rates have increased by 329 percent.

The county’s financial problems began several years ago when a federal court ordered it to rebuild their failed sewer system.  Bonds were issued to the county to finance the project.  These costs were inflated and put the county in $3.2 billion in debt.
